1. General Information
These Terms and Conditions govern the use of the website AnimArt.hr and the purchase of products offered through the online store.
By accessing this website or placing an order, you agree to these Terms and Conditions.
If you do not agree with these Terms, please do not use this website.

3. Definitions
- Seller means Animart Group j.d.o.o.
- Customer means any person purchasing products through the website.
- Consumer means a natural person acting outside their trade, business, craft or profession.
- Website means AnimArt.hr.
- Products means all goods offered for sale on the Website.
4. Scope
These Terms apply to every purchase made through AnimArt.hr.
The Seller reserves the right to amend these Terms at any time. Changes apply only to orders placed after publication.
5. Product Information
We make every effort to ensure product descriptions, photographs and specifications are accurate.
However:
- colours may vary depending on monitor settings;
- manufacturers may change packaging or minor product details;
- slight differences between images and delivered products do not constitute defects.
Limited edition, collectible and imported products may differ slightly from promotional images.
6. Availability
All orders are subject to product availability.
Items may occasionally become unavailable due to inventory discrepancies or supplier issues.
If a product cannot be supplied, we will notify you and offer either:
- a refund,
- a replacement product (where appropriate), or
- cancellation of the affected item.
7. Prices
All prices displayed on the Website include VAT unless otherwise stated.
Shipping costs are displayed separately during checkout.
We reserve the right to change prices without prior notice.
Price changes do not affect orders already confirmed.
8. Ordering Process
An order is placed after the Customer:
- selects products;
- provides the required information;
- chooses delivery and payment methods; and
- clicks the button confirming the order.
After submission, an automatic confirmation email acknowledges receipt of the order.
This confirmation does not constitute acceptance of the order.
The sales contract is concluded only after the Seller accepts the order and dispatches the goods.
9. Right to Refuse Orders
The Seller reserves the right to refuse or cancel an order if:
- pricing errors occurred;
- products became unavailable;
- fraud is suspected;
- payment cannot be verified;
- abusive or unlawful behaviour is detected.
10. Payment
Payment methods available are displayed during checkout.
Orders remain the property of the Seller until full payment has been received.
11. Shipping and Delivery
Delivery times shown are estimates only.
Delays caused by carriers, customs authorities, weather conditions or other events beyond our control do not constitute a breach of contract.
The Customer is responsible for providing accurate delivery information.
Additional shipping costs resulting from incorrect addresses may be charged to the Customer.
12. Inspection Upon Delivery
Customers should inspect packages upon delivery.
Visible transport damage should be reported to the carrier and to the Seller as soon as reasonably possible.
Failure to report visible damage immediately does not affect statutory consumer rights.
13. Right of Withdrawal
Consumers residing within the European Union generally have the right to withdraw from a distance contract within 14 days without giving any reason.
The withdrawal period expires 14 days after the day the Consumer acquires physical possession of the goods.
To exercise this right, the Consumer must notify the Seller by a clear written statement sent to:
The Consumer must return the goods without undue delay and no later than 14 days after notifying the Seller.
The Consumer is responsible for the direct cost of returning the goods unless otherwise agreed.
Returned goods must be complete and handled only to the extent necessary to establish their nature, characteristics and functioning.
The Seller may reduce the refund if the value of the goods has diminished due to handling beyond what is necessary.
14. Exceptions to the Right of Withdrawal
The right of withdrawal does not apply where permitted by applicable law, including but not limited to:
- sealed products unsuitable for return once unsealed due to health or hygiene reasons;
- custom-made or personalized products;
- newspapers or magazines (except subscriptions);
- digital content supplied electronically where performance has begun with the Consumer’s prior consent and acknowledgment of the loss of the withdrawal right.
15. Refunds
Refunds will be processed using the original payment method unless otherwise agreed.
Refunds are issued within the period required by applicable law after:
- receiving the returned goods; or
- receiving satisfactory evidence that the goods have been returned.
Original shipping costs are refunded only where required by applicable law.
Additional costs arising from the Customer selecting a more expensive delivery option than the standard delivery offered will not be refunded.
16. Non-Conforming or Defective Products
Consumers are entitled to statutory remedies for goods that do not conform to the sales contract in accordance with applicable Croatian and European Union legislation.
Where a product is defective or does not conform to the contract, the Consumer may be entitled to repair, replacement, price reduction or termination of the contract, depending on the circumstances and applicable law.
Nothing in these Terms limits statutory consumer rights.
17. Collectible Products
Many products sold by Animart are collectibles intended for display.
Minor imperfections to retail packaging, including small dents, scratches or shrink-wrap marks, may occur during manufacturing or transport and do not necessarily constitute a product defect where the item itself remains undamaged.
Unless expressly stated otherwise, we do not guarantee collector-grade packaging.
18. Pre-Orders
Pre-order products are subject to supplier availability.
Estimated release dates are provided by manufacturers and may change without notice.
Delays by manufacturers or distributors do not entitle Customers to compensation.
Customers may cancel a pre-order before dispatch unless otherwise clearly stated at the time of purchase.
19. User Accounts
Customers are responsible for maintaining the confidentiality of their account credentials.
The Seller may suspend or terminate accounts used for fraudulent, abusive or unlawful activities.
20. Intellectual Property
All website content, including logos, graphics, text, layouts and designs, is the property of Animart Group j.d.o.o. or its licensors and is protected by applicable intellectual property laws.
No content may be reproduced, copied or distributed without prior written permission.
Trademarks and product names belonging to third parties remain the property of their respective owners.
21. Limitation of Liability
To the fullest extent permitted by law, the Seller shall not be liable for indirect, incidental or consequential damages arising from the use of the Website or purchased products.
Nothing in these Terms excludes or limits liability that cannot legally be excluded under applicable law.
22. Force Majeure
The Seller shall not be liable for delays or failure to perform obligations caused by events beyond its reasonable control, including natural disasters, strikes, war, pandemics, governmental actions, transport disruptions or supplier failures.
23. Privacy
Personal data is processed in accordance with our Privacy Policy and applicable data protection legislation.

25. Governing Law
These Terms and all contracts concluded through the Website are governed by the laws of the Republic of Croatia.
Mandatory consumer protection provisions applicable in the Consumer’s country of residence remain unaffected where required by law.
26. Alternative Dispute Resolution
Consumers may use available out-of-court dispute resolution procedures where provided by applicable law.
Nothing in these Terms limits the Consumer’s right to seek judicial protection before the competent courts.
27. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
28. Entire Agreement
These Terms, together with the Privacy Policy, Cookie Policy and any other legal notices published on the Website, constitute the entire agreement between the Seller and the Customer regarding purchases made through AnimArt.hr.
